Please read this document carefully before accessing our website or enrolling in any program or event. By using our site or purchasing any service, you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, do not use our services.

1. General

This website (the “Site”) is owned and operated by Save My Marriage School Pty Ltd (ABN: 97 681 174 130) trading as Save My Marriage School (“SMMS”, “we”, “us”, or “our”), a company registered in Western Australia, Australia.

By accessing the Site or purchasing any of our programs, retreats, or services, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms applicable to specific products or services. These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.

We reserve the right to update these Terms at any time. We will post the updated version on our website with a revised date. Continued use of the Site following any changes constitutes your acceptance of those changes.

2. Eligibility

Our services are intended for adults aged 18 years and over. By accessing the Site or enrolling in any program, you confirm that you are at least 18 years of age. We do not knowingly collect personal information from or market to individuals under the age of 18. If you believe a minor has submitted personal information to us, please contact us at support@savemymarriageschool.com so we can remove it promptly.

3. SMS, Phone, and AI Voice Communications

By providing your phone number to SMMS through any form, registration, or purchase on our website or via our third-party platforms (including GoHighLevel), you expressly consent to receive communications from Save My Marriage School Pty Ltd, including:

Text messages (SMS) for marketing, program updates, coaching reminders, and follow-up communications
Phone calls, including calls using automated dialing systems, prerecorded messages, or artificial intelligence (AI) generated voice technology
Marketing and promotional communications about our programs, retreats, events, and related services

You acknowledge and agree that:

Your consent is not a condition of purchase. You may enrol in any program without consenting to marketing communications.
Standard message and data rates may apply to SMS communications.
You may opt out of text messages at any time by replying STOP to any message from us.
You may opt out of phone communications by emailing support@savemymarriageschool.com or verbally requesting removal during any call.
Opt-out requests will be processed within 10 business days.
You may revoke consent through any reasonable method, including email, voicemail, or verbal request. We are not limited to keyword-only opt-out methods.

AI voice calls will identify themselves as AI-generated at the commencement of the call. We comply with applicable Australian and international telecommunications laws in our communications practices.

4. Intellectual Property

Our Rights

All content on this Site, including but not limited to text, graphics, logos, images, audio and video recordings, course materials, worksheets, frameworks, and methodologies (including the SMMS 5-Step Relationship Framework and Trust Framework), is the property of Save My Marriage School Pty Ltd or its licensors and is protected under the Copyright Act 1968 (Cth) and applicable international copyright laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our content solely for your personal, non-commercial use as part of your enrolled program. You may not copy, reproduce, modify, distribute, sell, or create derivative works from our content without our prior written consent.

Your Submissions

By submitting any content, comments, testimonials, photos, or videos to us (via the Site, social media, email, or otherwise), you grant Save My Marriage School Pty Ltd a royalty-free, non-exclusive, worldwide licence to use, reproduce, modify, and display such material for the purposes of operating and promoting our business, including on social media platforms such as Instagram, Facebook, and YouTube.

This licence does not transfer ownership of your content to us. You retain ownership of any material you submit. The licence ends if you request removal and we are reasonably able to comply.

You represent that you own or have the right to submit any material you provide, and that your submission does not infringe the rights of any third party.

5. Disclaimers

Our programs and content are provided for educational and coaching purposes only. They are not a substitute for individual or couples therapy, medical advice, psychiatric treatment, or legal counsel. If you or your partner are experiencing a mental health crisis, domestic violence, or any other emergency, please contact a qualified professional or emergency services immediately.

To the maximum extent permitted by law, SMMS makes no warranties, express or implied, regarding the outcomes of our programs. Results vary significantly based on individual participation, effort, circumstances, and commitment.

We are not financial advisers, legal advisers, or medical practitioners. Nothing on this Site or in our programs constitutes financial, legal, or medical advice.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law and the Competition and Consumer Act 2010 (Cth), our total liability to you for any claim arising from or related to our services is limited to the total fees paid by you to SMMS in the 12 months preceding the event giving rise to the claim.

We are not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, loss of data, or emotional distress, arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes any rights you have under the Australian Consumer Law as a consumer, including statutory guarantees that cannot be excluded.

7. Indemnification

You agree to indemnify, defend, and hold harmless Save My Marriage School Pty Ltd, its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

Your breach of these Terms of Service
Your use of the Site or our services
Any content you submit to us or post in our community platforms
Your violation of any law or the rights of any third party

8. Save My Marriage School Program

8.1 Program Description

Save My Marriage School (SMMS) is a relationship coaching program offering education, tools, and support to couples committed to improving their relationship. The program includes live coaching sessions, digital course content, worksheets, and optional community participation via our Skool community platform.

8.2 Commitment and Participation

By enrolling in the 12-month program, you acknowledge that your outcomes depend on your individual participation, effort, and openness to coaching. We do not guarantee specific results. Results vary based on the couple’s unique circumstances and level of engagement.

8.3 Refund Policy

SMMS operates a strict no-refund policy for our coaching programs, except as required under the Australian Consumer Law (ACL).

We do not offer refunds for:

Change of mind after purchase
Failure to participate or engage with the program
Changes in personal circumstances
A partner’s choice not to engage
Non-completion of the program

Your rights under Australian Consumer Law are not excluded. You are entitled to a remedy if the service is not provided with due care and skill, is not fit for the described purpose, or differs significantly from what was advertised. In the event of a major failure under the ACL, you may be entitled to a refund or other remedy as required by law.

If any refund is approved, the following fees apply to cover reasonable administrative and processing costs: a 3% payment processing fee based on the total amount paid, plus a $150 administrative fee. These fees will be deducted from any refundable amount. They do not apply in the case of a major failure under the ACL where a full refund is required by law.

8.4 Cancellations, Pauses, and Transfers

When you enrol in Save My Marriage School, you commit to a full 12-month program. You are responsible for the full 12 months of payments regardless of changes in personal circumstances.

We do not offer early termination or cancellation of your membership. However, in exceptional circumstances, we may at our sole discretion allow:

A one-time pause of your subscription for up to three months. During any pause, program access and payments are placed on hold and resume automatically at the end of the agreed pause period.
All pause requests must be submitted in writing to support@savemymarriageschool.com and approved by us in writing before taking effect.
Pauses are assessed on a case-by-case basis and are not guaranteed.

Transfers of your enrolment to another person, or credits toward other services (such as retreats), are not routinely offered but may be considered at our discretion in exceptional circumstances.

8.5 Program Access

Access to program content is granted for the duration of your enrolment and is personal to you. Sharing login credentials or reselling program access is strictly prohibited and constitutes copyright infringement. If payment for the program is declined, your access will be suspended. We will make reasonable efforts to contact you to resolve any payment issue.

8.6 1:1 Coaching Calls

It is your responsibility to book your coaching calls within the agreed timeframe. Calls not booked within the applicable period will be forfeited.

If you need to reschedule a call, you must do so at least 48 hours before the scheduled time. Calls rescheduled with less than 48 hours notice will be forfeited.

Each coaching call is a maximum of 60 minutes. If you join late, your call will not be extended beyond the originally scheduled end time. It is your responsibility to initiate the call at the agreed time.

There are no refunds for 1:1 coaching calls.

You may cancel your 1:1 coaching subscription at any time after the first 90 days by providing 14 days written notice to support@savemymarriageschool.com before your next billing date. Your subscription will end after the current paid month of coaching has concluded. If a payment falls due within the 14-day notice period, that payment will be processed and your subscription will end at the conclusion of that month.

9. Live Events and Retreats

9.1 No Refunds for Events

All sales for live events and retreats are final. We do not offer refunds for:

Change of mind
Non-attendance
Scheduling conflicts
Travel or personal circumstances, including relationship breakdown or illness

Your rights under the Australian Consumer Law are not excluded. You are entitled to a remedy if the event is cancelled by us and not rescheduled, if what is delivered differs significantly from what was advertised, or if the service is not provided with due care and skill.

We reserve the right to make reasonable changes to event schedules, facilitators, or venue locations where the core content and outcomes of the event remain substantially the same. We will provide reasonable notice of any such changes.

9.2 Medical and Fitness Responsibility

Certain retreat activities, including breathwork, cacao ceremony, and ice baths, involve physical or physiological processes that carry inherent risk. Before registering for any retreat that includes these activities, you are required to:

Consult your general practitioner or a qualified medical professional to confirm your fitness to participate
Disclose to SMMS in writing any medical conditions, medications, or circumstances that may be relevant to your safe participation
Advise the facilitator on arrival of any conditions arising after your registration

Participation in these activities is voluntary. You assume full responsibility for your participation and release Save My Marriage School Pty Ltd, its directors, employees, facilitators, and contractors from any liability arising from your participation, to the maximum extent permitted by law.

Breathwork

Breathwork involves a two-step circular breathing technique and may produce intense physical, emotional, or energetic responses. Individuals with the following conditions should not participate without prior written medical clearance: cardiovascular disease, uncontrolled high blood pressure, glaucoma, detached retina, kidney disease, severe asthma, osteoporosis, recent injuries or surgeries, severe mental illness (including bipolar disorder or psychosis), seizure disorders, aneurysms, or pregnancy.

Cacao Ceremony

Ceremonial cacao contains monoamine oxidase inhibitors (MAOIs) and may interact with certain antidepressant medications. If you have hypertension, chronic cardiovascular conditions, epilepsy, schizophrenia, nut allergies, or have had general anaesthesia within two weeks of the event, consult your doctor before participating. Cacao is not a compulsory component of our retreats.

Ice Baths

Participation in ice bath activities carries inherent risks including hypothermia and cold shock. If you have heart conditions, respiratory conditions, circulatory disorders, hypertension, Raynaud’s disease, or are pregnant, you must obtain medical clearance before participating. By participating, you assume all risks and release SMMS and its team from any liability arising from your participation.

9.3 Audio/Visual Release

Portions of our live events may be recorded in video and audio and/or captured in photographs. By registering for and attending any SMMS event, you consent to the use of recordings or photographs in which you appear for marketing, advertising, and promotional purposes across all media, including social media platforms (including but not limited to Instagram, Facebook, YouTube, and TikTok), our website, email communications, and paid advertising, without further compensation, permission, or notification.

If you do not wish to be recorded or photographed, you must notify us in writing at the time of registration. We will make reasonable efforts to accommodate your request but cannot guarantee complete exclusion from incidental footage.

9.4 Participant Conduct

All attendees are required to behave respectfully and professionally toward staff, facilitators, speakers, and fellow participants at all times, including during breaks and informal periods.

SMMS reserves the right to remove any participant from an event without refund if they are deemed to be behaving in a manner that is disruptive, disrespectful, intoxicated, in possession of illegal substances, or otherwise in breach of these terms.

10. Online Community

Access to our private online community (currently hosted on Skool) is provided as a complementary feature of certain programs. Participation in the community is subject to our community guidelines.

We reserve the right to remove any member from the community at any time, without warning or refund, for behaviour that is disrespectful, harmful, negative, or inconsistent with our community standards. Removal from the community does not affect your access to your coaching sessions or enrolled program.

11. Acceptable Use of the Site

You agree not to use this Site to:

Violate any applicable law or regulation
Impersonate any person or entity
Transmit any harmful, defamatory, obscene, or unlawful content
Interfere with or disrupt the Site or its servers
Attempt to gain unauthorised access to any part of the Site or our systems
Harvest or collect personal information of other users without consent
Use the Site for any commercial purpose without our prior written consent

12. Third-Party Links and Services

Our Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or services of any third-party sites. Links do not imply endorsement. You access third-party sites at your own risk.

13. Dispute Resolution

We are committed to resolving disputes in a fair and timely manner. If you have a complaint or dispute, please follow this process:

Step 1: Contact us in writing at support@savemymarriageschool.com, clearly describing the nature of the dispute and the outcome you are seeking.
Step 2: We will acknowledge your complaint within 5 business days and respond substantively within 30 days.
Step 3: If the dispute is not resolved within 30 days, the parties agree to attempt to resolve it through mediation with a mutually agreed mediator in Perth, Western Australia, before commencing any legal proceedings.
Step 4: If mediation is unsuccessful, either party may refer the matter to the courts of Western Australia.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court where necessary to protect their rights.

14. Force Majeure

SMMS will not be in breach of these Terms or liable to you for any delay or failure to perform our obligations where such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, government action, platform outages, illness of key personnel, power failure, or civil unrest.

In the event of a force majeure affecting a live event or retreat, we will make reasonable efforts to reschedule or provide an alternative. Where rescheduling is not possible and a major failure under the ACL has occurred, your statutory rights to a remedy are not affected.

15. Operational Breaks

SMMS is a family-operated business. Every few months, our team takes a scheduled break of one to two weeks to rest and recharge. During this time, access to coaching sessions, live sessions, and community support may be temporarily paused. Limited email support will remain available. We will provide reasonable advance notice of any scheduled breaks. Our commitment to deliver your full program entitlement is not affected by these breaks.

16. Data Breach Notification

We take the security of your personal information seriously. In the event of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth). Notification will occur as soon as practicable and will include the nature of the breach, the information affected, and the steps we are taking in response.

17. Termination

We may suspend or terminate your access to the Site or any of our programs at any time and without notice if you breach these Terms of Service or behave in a manner that we consider harmful to other clients, our staff, or our business. Our obligations under the Australian Consumer Law are not affected by any termination.

18. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. Any dispute not resolved through the dispute resolution process in clause 13 will be subject to the non-exclusive jurisdiction of the courts of Western Australia.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed from these Terms and will not affect the validity or enforceability of the remaining provisions.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy and any product-specific terms communicated at the point of sale, constitute the entire agreement between you and Save My Marriage School Pty Ltd with respect to your use of our Site and services.
